Terms and Conditions of the pic a bec Online Store

These Terms and Conditions define the rules for using the pic a bec online store, in particular the rules for placing orders, concluding sales agreements, delivery, payments, withdrawal from the agreement, and complaint procedures.

1. General provisions

The online store operates under the pic a bec brand and sells clothing and accessories for golfers via the Internet.

The Terms and Conditions define:

  • the rules for using the online store,
  • the rules for placing orders,
  • the rules for concluding and fulfilling sales agreements,
  • delivery and payment terms,
  • the rules for withdrawal from the agreement,
  • the rules for submitting and handling complaints.

The Customer is obliged to use the store in accordance with the law, good practices, and the provisions of these Terms and Conditions.

2. Definitions

Seller

The entity operating the pic a bec online store, whose identification and contact details are provided on the store’s website.

Store

The online store operated by the Seller via the website.

Customer

A natural person, legal person, or organizational unit with legal capacity making a purchase in the Store.

Consumer

A Customer who is a natural person making a purchase not directly related to their business or professional activity.

Entrepreneur with consumer rights

A natural person concluding an agreement directly related to their business activity, where the content of the agreement indicates that it is not of a professional nature for that person.

Product

A movable item available in the Store, in particular clothing, additions, and accessories of the pic a bec brand.

Order

A Customer’s declaration of intent aimed directly at concluding a sales agreement for a Product or Products.

4. Types and scope of electronically supplied services

Through the Store, the Seller enables the Customer to:

  • browse the Product offer,
  • conclude online sales agreements for Products,
  • create and maintain a Customer account, if such functionality is available,
  • contact the Seller via the contact form or email.

Services provided electronically are free of charge, unless explicitly stated otherwise.

5. Conditions for using the Store

In order to use the Store, the following are required:

  • a device with Internet access,
  • an up-to-date web browser,
  • an active email account,
  • enabled cookies and JavaScript support, if required for the proper operation of the website.

The Customer is obliged to provide accurate and truthful information.

It is prohibited for the Customer to provide unlawful content.

6. Information about Products and prices

All Products presented in the Store are brand new unless otherwise clearly stated in the Product description.

The Products offered by pic a bec include, in particular, clothing inspired by golf style and designed for people who value aesthetics, comfort, and functionality both on and off the golf course.

Product prices are given in Polish zloty and are gross prices unless otherwise stated.

Delivery costs may be added to the Product price and are indicated to the Customer before placing an Order.

Information about Products presented in the Store constitutes an invitation to conclude an agreement and does not constitute an offer within the meaning of the Polish Civil Code.

7. Placing orders

The Customer may place Orders through the Store 24 hours a day, 7 days a week.

To place an Order, the Customer:

  • selects a Product or Products,
  • adds them to the cart,
  • completes the data required for Order fulfillment,
  • selects the delivery and payment method,
  • accepts these Terms and Conditions,
  • confirms the Order and submits it for processing.

Submitting an Order constitutes the Customer’s offer to purchase the selected Products.

After receiving the Order, the Seller sends confirmation of receipt to the email address provided by the Customer.

The sales agreement is concluded when the Seller accepts the Order for processing.

8. Payments

The Customer may use the payment methods available in the Store, in particular:

  • traditional bank transfer,
  • online instant transfer,
  • card payment,
  • cash on delivery payment, if such an option is available.

Available payment methods are indicated in the Store before placing the Order.

If payment is not made within the deadline specified by the Seller, the Order may be canceled.

9. Delivery

Orders are fulfilled within the territory specified in the Store.

Delivery is made to the address provided by the Customer when placing the Order.

Available delivery methods and their costs are indicated to the Customer before placing the Order.

The Order fulfillment time is calculated from the moment the payment is credited or the Order is accepted for processing in the case of cash on delivery payment.

For Products with limited availability or made to individual order, the fulfillment time may be longer, of which the Customer will be informed.

10. Customer account

If the Store allows account registration, the Customer may create an account by completing the registration form.

Creating an account is voluntary and free of charge.

The Customer is responsible for maintaining the confidentiality of login credentials for the account.

The Seller may block the Customer’s account in the event of a violation of these Terms and Conditions or applicable law.

11. Withdrawal from the agreement

Consumers and Entrepreneurs with consumer rights have the right to withdraw from a distance sales agreement within 14 days without providing any reason.

The withdrawal period begins on the day the Customer or a third party indicated by the Customer takes possession of the Product.

To exercise the right of withdrawal, the Customer should submit a clear statement to the Seller, for example by email or in writing.

The Customer may use the sample withdrawal form, although this is not mandatory.

In the event of withdrawal from the agreement, the Seller shall refund all payments received from the Customer, including the costs of the cheapest standard delivery offered by the Store, no later than within 14 days from the date of receipt of the withdrawal statement.

The refund will be made using the same payment method used by the Customer unless the Customer expressly agrees to another solution.

The Customer should return the Product immediately, no later than within 14 days from the date of withdrawal from the agreement.

The Customer bears the direct costs of returning the Product unless the Seller informs otherwise.

The Customer is responsible for any reduction in the value of the Product resulting from its use beyond what is necessary to determine the nature, characteristics, and functioning of the Product.

12. Exclusions from the right of withdrawal

The right of withdrawal does not apply in cases provided for by law, in particular with regard to Products:

  • made according to the Customer’s specifications or intended to meet their individual needs,
  • delivered in sealed packaging that cannot be returned for hygiene reasons after opening the packaging, if the packaging was opened after delivery,
  • liable to deteriorate rapidly or having a short shelf life.

13. Complaints regarding Products

The Seller is obliged to deliver a Product that complies with the agreement.

If the Product is not compliant with the agreement, the Customer may submit a complaint in accordance with applicable law.

The complaint should include:

  • the Customer’s full name or company name,
  • contact details,
  • Order number,
  • a description of the issue,
  • the Customer’s request, if specified.

Complaints may be submitted electronically or in writing using the Seller’s contact details.

The Seller will consider the complaint within 14 days from the date of its receipt.

14. Complaints regarding electronically supplied services

The Customer may submit complaints regarding the operation of the Store or the Customer account electronically to the Seller’s email address.

In the complaint submission, it is recommended to provide information allowing identification of the Customer and a description of the reported issue.

The Seller will consider the complaint within 14 days from the date of its receipt.

15. Product reviews

If Product reviews are published in the Store, the Seller takes actions to ensure that they come from persons who have actually purchased or used the Product.

Detailed rules regarding the publication of reviews may be specified separately on the Store’s website.

16. Personal data

Customers’ personal data are processed by the Seller in accordance with applicable law and the Privacy Policy available on the Store’s website.

Providing personal data is voluntary, but it may be necessary for concluding and performing the sales agreement.

17. Intellectual property

All content published in the Store, including in particular the pic a bec name, descriptions, photos, graphics, and visual identity elements, is legally protected.

Without the Seller’s prior consent, copying, distributing, or using this content for purposes other than permitted by law is prohibited.

18. Out-of-court dispute resolution methods

The Consumer has the option of using out-of-court methods for handling complaints and pursuing claims in accordance with applicable law.

Detailed information in this regard is available, among others, on the websites of relevant consumer protection authorities.

19. Final provisions

Matters not regulated by these Terms and Conditions shall be governed by the relevant provisions of Polish law.

These Terms and Conditions enter into force on the date of their publication on the Store’s website.

The Seller reserves the right to amend these Terms and Conditions for important reasons, in particular in the event of changes in law, payment or delivery methods, or functional changes to the Store.

Sales agreements concluded before the new Terms and Conditions enter into force shall be governed by the Terms and Conditions applicable at the time the Order was placed.
